Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of Rentol.ca (the "Site" or "Platform"), owned and operated by 14047907 Canada Inc. (doing business as "Rentol"), a corporation incorporated under the laws of Canada ("we," "us," or "our").

By accessing or using the Site, creating an account, listing a rental property, or inquiring about a rental property, you ("User," "you," or "your") confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Site.

1. Nature of the Platform

Rentol is a peer-to-peer marketplace only. We provide an online platform that connects individuals who wish to list rental properties ("Landlords") with individuals seeking rental accommodations ("Tenants"). Rentol is not a landlord, property manager, real estate broker, real estate agent, or intermediary. We do not own, manage, or control any rental properties listed on the Site.

Rentol facilitates the connection between Landlords and Tenants. All transactions, arrangements, lease agreements, and tenancy relationships are solely between the Landlord and the Tenant. Rentol is not a party to any agreement entered into between Landlords and Tenants, including but not limited to lease agreements, rental contracts, or any other arrangements regarding a rental property.

You use this Platform entirely at your own risk. By using Rentol, you acknowledge that you assume full responsibility and all risks arising from your use of the Platform and any transactions you enter into with other Users.

Beware of rental scams. Rentol strongly advises all Tenants to never send money, e-transfers, wire transfers, or any form of payment for a rental property that you have not physically visited and verified in person. Rentol is not responsible for any losses arising from fraudulent listings or rental scams.

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting the foregoing, Rentol makes no warranty or representation that:

To the maximum extent permitted by applicable law, 14047907 Canada Inc., its directors, officers, employees, agents, affiliates, successors, and assigns (collectively, the "Rentol Parties") shall not be liable for any:

If, notwithstanding the foregoing, any Rentol Party is found liable, the aggregate liability of all Rentol Parties shall not exceed the lesser of (a) the total fees paid by you to Rentol in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred Canadian dollars (CAD $100.00).

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless the Rentol Parties from and against any and all claims, demands, actions, suits, proceedings, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or in connection with:

All content published and made available on the Site is the property of 14047907 Canada Inc. and the Site's creators. This includes, but is not limited to, images, text, logos, documents, downloadable files, and anything that contributes to the composition of our Site. You may not reproduce, distribute, or use any of our intellectual property without prior written consent.

When you create an account on the Platform, you agree that:

If we believe you are violating these Terms, we reserve the right to limit, suspend, or terminate your access to the Platform without notice. We also reserve the right to take any legal steps necessary to prevent further violations.

Users may post the following types of content on the Platform:

By posting content on the Platform, you grant Rentol a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to use, display, reproduce, and distribute your content in connection with operating and promoting the Platform. You represent and warrant that you own or have the necessary rights to all content you post and that your content does not infringe any third-party rights.

12. Payments

We accept Credit Card payments on the Site, processed through our third-party payment processor (Stripe). When you provide your payment information, you authorize us to charge the amount due to the payment instrument you have selected.

Payments processed through the Platform are for Rentol's service fees and promotional features only. Rent payments, security deposits, and any other payments between Landlords and Tenants are arranged directly between the parties and are not processed through Rentol. Rentol bears no responsibility for any payments made between Users outside the Platform.

If we believe your payment has violated any law or these Terms, we reserve the right to cancel or reverse your transaction.

13. Subscriptions and Promotions

If you subscribe to any paid services or promotional features on the Platform, your subscription will automatically renew at the end of each billing period. You will be automatically billed until we receive notification that you wish to cancel your subscription. You may cancel at any time by contacting us or through your account settings.

14. No Landlord-Tenant Relationship with Rentol

Nothing in these Terms or your use of the Platform creates a landlord-tenant relationship, agency relationship, joint venture, partnership, employment, or franchise relationship between you and Rentol. Rentol does not act as an agent for any Landlord or Tenant. Any landlord-tenant relationship exists solely between the Landlord and the Tenant, and is governed by the applicable lease agreement and landlord-tenant legislation in the relevant jurisdiction.

15. Dispute Resolution Between Users

Any disputes arising between Landlords and Tenants are solely between those Users. Rentol is not obligated to mediate, arbitrate, resolve, or become involved in any disputes between Users, including but not limited to disputes regarding lease terms, rent payments, security deposits, maintenance, evictions, or property condition. You agree to resolve any disputes with other Users directly, including through the applicable Landlord and Tenant Board or court of competent jurisdiction, without involving Rentol.

16. Links to Third-Party Websites

The Platform may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party website or service. It is your responsibility to review the terms and privacy policies of any third-party websites you visit.

17. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

18. Consumer Protection Law

Where the Consumer Protection Act, 2002 (Ontario), the Residential Tenancies Act, 2006 (Ontario), or any other consumer protection or landlord-tenant legislation in your jurisdiction applies and cannot be excluded, these Terms will not limit your legal rights and remedies under that legislation. These Terms will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and that legislation, the mandatory provisions of the legislation will apply.

19. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in the Province of Ontario for the resolution of any disputes arising under or in connection with these Terms.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity of any provision shall not affect the validity or enforceability of the remaining provisions.

21. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Rentol with respect to your use of the Platform. These Terms supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.

22. Changes to These Terms

We reserve the right to amend these Terms at any time. Changes will be effective upon posting to the Platform. We may notify Users of material changes by email or by posting a prominent notice on the Site. Your continued use of the Platform after any changes to these Terms constitutes your acceptance of the revised Terms.
